What to Do If You’re Involved in an Accident with a Drunk Driver

Actions you need to take at the accident scene to ensure compensation

While you are dealing with the pain of being in the accident, you must also deal with doctors and other appointments to help you recover both physically and monetarily.

In addition to contacting an attorney experienced in auto accidents, there are 5 other crucial steps you should take to ensure you are compensated.

At the scene of the accident

  1. Stop and remain at the scene

Immediately after an accident, let your vehicle come to a stop and assess the situation. Don’t leave the accident scene unless the scene poses a safety risk. You should then call 911 for police and EMS services (required by most insurance companies) and check on the other passengers. If you are able, you should assist any other injured victims.

  1. Take photographs

Since most everyone now has cell phones equipped with cameras, you should also take photos of the accident scene. These photos will stand as both evidence for your attorney and insurance company. Photos are also the easiest way to establish the specifics of the crash site. These include:

    • Weather conditions
    • The layout of the intersection and highway
    • The existence and type of signs and traffic signals
    • Any objects that could affect drivers’ visibility
    • Any outside factors that could have caused the crash (like construction work)

You should also take care to photograph the injuries of all those involved. If possible, these photos should be taken before the injured are taken to the hospital.

  1. Gather information at the scene

The police will take down the personal information of those at the scene, yes, but it is just as important for you to gather your own witnesses because the police will be busy at the accident scene and could miss an important witness.
