Got the maximum settlement

“Stephanie and her staff are great. Navigating a combined workman’s comp and personal injury case on my own would have been extremely daunting. I’m positive I would not have gotten the settlement that I received without Stephanie’s expertise. She went to bat with 3 insurance companies to get the maximum settlement. I’m very grateful and highly recommend this practice.”

Highly recommend this law firm

“Our experience with Babcock Law Firm has been worth 5 stars, a workman’s comp claim is a trying adventure. Our attorney Stephanie Tucker and her assistant Kenzi Holman were amazing, keeping us informed and so patient with our questions and easing our stress. We all had to work together, and we made a great team. With hard work, a lot of hours and prayers, our case came to a close and we were pleased with the outcome. I would highly recommend this law firm. Thanks to everyone who played a part in helping us.”

FAQs about workers’ comp claims in the Denver Tech Center

Can I claim compensation for an injury at work in Colorado?

In most cases, yes. Colorado’s workers’ compensation system covers most employees who are hurt on the job or develop a medical condition caused by their work (often referred to as an occupational disease or illness).

It includes everything from sudden injuries like broken bones, spinal cord injuries, and head injuries to conditions that develop over time like repetitive stress injuries, hearing loss, lead poisoning, and cancer.

You’re generally eligible as long as you’re classified as an employee, regardless of whether you’re full-time, part-time, or seasonal.

However, some workers don’t qualify for CO workers’ comp, including:

  • Independent contractors
  • Certain maintenance or agricultural workers who earn under $2,000 per year
  • Domestic workers who don’t work full-time
  • Federal and railroad employees who are covered under different systems

The key requirement for eligible employees is that their injury or illness must be directly related to their jobs.

Workers do not need to prove their employer or anyone else caused their injury to receive benefits, and in most cases, a worker can even get benefits if they made a mistake that led to their own injury.

If you’re unsure whether you qualify for workers’ comp in Colorado or your employer is claiming you don’t, be sure to have a Denver Tech Center workers’ comp attorney review your employment status and help confirm your eligibility for benefits.

What does workman’s comp cover in Colorado?

In Colorado, workers’ compensation is designed to cover the essential costs that come with a work-related injury or illness. While it doesn’t pay for everything, it provides several key benefits to help you recover physically and financially after an accident.

Here’s what’s typically covered under Colorado’s workers’ comp system:

  • Lost wages. If you can’t work for more than 3 days, you may qualify for temporary disability benefits, which generally pay about two-thirds of your average weekly wage, up to a state-set maximum.
  • Disfigurement. Workers who suffer permanent scarring or visible disfigurement—especially to the face, head, or hands—may qualify for an additional lump-sum payment.
  • Work-related death. If a worker dies because of a job-related injury or illness, surviving dependents may receive weekly payments and funeral expense coverage.
  • Medical care. All reasonable and necessary medical treatment related to your injury or illness—doctor visits, surgery, prescriptions, rehabilitation, and even mileage to and from appointments—is covered, as long as you see an approved provider.
  • Permanent disability. If your injury leaves lasting limitations, you may receive permanent partial or permanent total disability benefits, depending on how your condition affects your ability to work.

Many types of workers’ comp benefits can be negotiated with the insurance company, especially for claims involving permanent conditions and catastrophic injuries.

If you’re not sure whether the benefits you’re being offered are fair, discuss your claim with a local Colorado work injury attorney who can assess the true value of your claim and handle negotiations with insurers to maximize your compensation.

How long can you wait to file a workman’s comp claim in Colorado?

You typically have up to 2 years from the date of your injury—or from when you discovered a work-related illness—to file a formal workers’ compensation claim with the Colorado Division of Workers’ Compensation. This is done by submitting Form WC 15, called the “Worker’s Claim for Compensation.”

However, even before that, there are other important rules you must follow to remain eligible for benefits, including:

  • You must get medical treatment from an employer-approved doctor. Except in an emergency, you’ll need to see a doctor approved by your employer or their insurance company. This provides documentation linking your injury to your job and ensures your bills are covered.
  • You must report your injury to your employer within 10 days. Even if your supervisor already knows, you should officially report it in writing. Failing to do so can delay or hurt your claim.

Once your claim is filed, the insurance company usually has 20 days to respond with an approval or denial.

If you’re worried you’ve missed a deadline or you believe your claim has been wrongfully denied, reach out to a Denver Tech Center workers’ compensation attorney for help getting your claim back on track before time runs out.
